 CMS To Humana: Stop Mailings 

 

WASHINGTON BUREAU -- The Centers for Medicare and Medicaid Services has told Humana Inc. to stop mailing subscribers a letter suggesting that health care reform legislation could cause them to lose Medicare Advantage benefits and services.

The Humana letter warns that enrollees could lose Medicare Advantage plan access, “ultimately urging them ‘to contact congressional representatives to protest actions referenced in the letter,’” Teresa DeCaro, acting director of the CMS’ Medicare Drug and Health Plan Contract Administration Group, writes in a letter sent Friday to Gail Miller, a vice president at Humana, Louisville, Ky.

CMS is concerned that, “among other things, this information is misleading and confusing to beneficiaries, represents information to beneficiaries as official communications about the Medicare Advantage program, and is potentially contrary to federal regulations and guidance for the Medicare Advantage and Part D programs under Medicare and other federal laws,” DeCaro writes.

“As we continue our research into this issue, we are instructing you to end immediately all such mailings to beneficiaries and to remove any related materials directed to Medicare enrollees from your website,” DeCaro writes.

Humana is cooperating with CMS on resolving concerns about the enrollee mailing, says Tom Noland, a Humana spokesman.

DeCaro sent the letter to Humana in response to a request from Senate Finance Committee Chairman Max Baucus, D-Mont. who has accused Humana of misrepresenting the Medicare Advantage provisions in his America’s Healthy Future Act proposal.

The Senate Finance Committee is set to begin marking up an AHFA bill Tuesday.

The AHFA proposal could cut the total amount of funding set to go to the Medicare Advantage program by about $123 billion over the next 10 years, according to a Congressional Budget Office estimate released Wednesday.

Other proposals circulating in Congress could cut the Medicare Advantage budget allocation by about $175 billion over 10 years.

Advocates of the cuts want to use the money to help pay for health coverage for Americans who are now uninsured.

Baucus said today that he has asked CMS to “condemn” insurance industry “scare tactics,” Baucus said the health reform legislation he introduced “will include significant improvements to the Medicare program that will benefit seniors.”

It is “wholly unacceptable for insurance companies to mislead seniors regarding any subject – particularly on a subject as important to them, and to the nation, as health care reform,” Baucus said.

The “false claims” in the Humana letter to beneficiaries include the allegation that seniors could lose Medicare Advantage program benefits, Baucus said.

Baucus said his legislation does not include cuts to Medicare benefits and would, instead, “improve the value of Medicare Advantage by reforming payments so that they appropriately reimburse insurers for their costs and promote plans that offer high quality, efficient health care for seniors.”

He also noted that that the independent Medicare Payment Advisory Commission has found that even after controlling for the cost of delivering benefits, of marketing, and of profits, Medicare Advantage plans get 14% more, on average, than the traditional Medicare program.

    • Apparently, free speech continues to be attacked in the name of "correctness". The congressman should go back to last year to see how many changes were made by CMS over and over and over. It is certainly reasonable to tell one's clients that the current situation represents more changes and maybe, just maybe, Seniors would like to contribute something to the debate. Oh pardon me, its no longer a debate. I forgot.

    • GENERALLY SPEAKING, THE ADVANTAGE PROGRAM BECOMES MEDICARE FOR THOSE ENROLLEES AND REDUCES OVERALL COST, IF THE INSURANCE CARRIERS CASN PROVIDE THIS PROGRAM AND STILL MAKE A PROFIT, THEN IT SPEAKS VOLUMES FOR THE EXPERTISE OF THE HEALTH INSURANCE INDUSTRY'S ABILITY TO MANAGE COST AND DELIVER SERVICES. CAN A GOVERNMENT APPOINTED ENTITY IMMEDIATELY GAIN THE ABILITY TO PERFORM AT THE SAME LEVEL?     • So how is cutting $175 billion from Medicare Advantage not cutting Medicare Advantage???? So much for this administration wanting full disclosure and transparancy. They only want that when it benefits them.

    • Several companies have dropped out of the MA program for 2010. If there are additional reductions there will be more. So, yes there WILL be cuts in the MA program and the public should know this now. The MA program is one of the best deals seniors have.

    • Thank you for informing your clients and mine regarding the Med Advantage costs and coverage. It's a shame that the gov. can't come right out and say that they cut part B reinburmenet by 4% (approx $90.00) when health care rose 6%. Where do they think the additonal $90.00 is going to come from. Good job for keeping your patrons informed!

    • I'm an insurance agent and I work in the senior market. I've never been fan of Humana, but I have to come to their defense on this issue. Humana is telling the TRUTH, and the govt (Obama) is using its immense power to pressure Humana and others to shut up. The war has begun people, and the govt stooges have an unfair advantage.

    • I believe Max Baucus about as much as I believe President Obama. All I hear from the democrats are lies, lies, and more lies. God forbid they even consider what the Republicans might like added. I've been to the a couple of Town Hall meetings, and I have spoken to quite a few seniors. It's apparently ok for the LIBERALS like Baucus to equivocate, but will have a fit if anyone else does it. I don't see where Humana lied. From what I've read Humana told it's seniors the COULD lost their coverage, not that they would. Most seniors I know receive a monthly social security check of under or close to $1,000.00. Out of that they have to already pay a monthly Medicare premium, not to mention the premium for a Medicare Advantage plan. Most would rather be on a Medicare Supplement [Plan F], but can't afford it...even without the drug plan. Stand alone drug plans can cost $40.00 plus per month. Shall we discuss the "donut hole???" The Obama wants to hack away at the Medicare Advantage Plan no matter what kind of twist they put on it. Humana is absolutely right to suggest the seniors notify their congressmen...before it's too late!

    • When will these idiots understand, or perhaps they don't want to, that for the 14% difference in funding for Part C plans, the beneficiary receives many more benefits. These benefits include the Part D drug coverage and preventative care. It's like the 47 million uninsured, even when you show them their logic is flawed, the continue to spout their mantra. What are we spending to fund Congress's health care? Stop picking on the senior. Shame on them.

    • The Humana corporation, as one of the largest contractors for Medicare Advantage plans, is justified in its concerns about the adverse financial implications of proposed health care reform legislation. While Medicare Advantage plans offer generous benefits at low subscriber costs to their members, the operating profits for plan sponsors are excessive and per capita payments by CMS under Obamacare will surely be subject to cuts. In their efforts to protect their largess, I'm only surprised that Humana didn't use a surrogate to seek to marshal their troops, while keeping a low corporate profile.

    • I really think that Humana's tactics are unconscionable. Senior citizens get frightened easily about so many things, and their letter was untruthful. They should be penalized for this behavior, but it still doesn't take away the fear that they have created.

    • Humana really began this effort to stop free speech about 3 years ago. Then Humana sent a letter to its agents and told them not to talk to their Congressman without approval of our message from Humana. What Humana wanted to do to its agents - GAG us - they are getting back. I have no sympathy
